Since the Turco case it's clarified by the ECJ that is only relates to ongoing court cases to which they are a party. I've already points to some argument raised here by Luxembourg , in my analysis of the Council meeting in May, see my comments after Mr. LEGLISE-COSTA's speech on https://www.unitary-patent.eu/content/council-meeting-may-30th-2011-some-clouds-threatening-official-blue-sky-unitary-patent No doubt for me that the agreement is illegal without EU being a party to this agreement.
